Do any business registration or licensing obligations apply?

Hosts who engage in “economic activities” generating invoices or tax obligations must set up a business or become an independent worker/sole trader. If you are already an independent worker/sole trader, please note that you shall update the definition of your economic activity before the tax authorities if your current definition does not cover the object of your Experience. Some activities may require a specific business license or registration, such as providing touristic activities. If you are unsure if you need a business license, we recommend you get in contact with the following authorities. The “Empresa na Hora” initiative provides advice and enables you to incorporate your business in a fast and cost-efficient way. Their services are available at their many locations, or online via the Empresa na Hora website. For information on the specific business licenses and further additional licenses needed for touristic activities, you can contact Turismo de Portugal.

What legal structure could I choose?

You have few different options to choose in structuring your business. You can elect to register as an independent worker or sole trader. Or you can incorporate (create a company) using the various options available to you depending on the size and type of your business. The official guide from the Portuguese Trade and Investment Agency provides information on the different types of companies to help you decide which may best suit your needs. If you find you still are unsure, advice can be obtained from the Empresa na Hora website, or your local legal or tax professional.

What things do I need to be aware of when dealing with consumers?

Hosts who regularly provide goods or services to consumers in exchange for money will be subject to the Consumer Protection Act.

The Consumer Protection Act requires that consumers are treated fairly and are not misled by incomplete, missing or unclear information. Hosts are required to provide Guests with all the information they need to know to make informed decisions about your services (main characteristics of the activity, prices, special terms and conditions, etc.) in a way which is transparent and easy to understand. Helpful information may also be found on the Consumer Portal of the Consumer Directorate General of Portugal.

Is there anything else I should be thinking about?

Yes. You may want to take tax and insurance into consideration when starting a business. You can find out how tax and accounting rules may apply to your activities from the Portuguese Tax Authority website, or by consulting a local tax, accounting, or legal professional directly.

You should also make sure you have the right insurance coverage for all the activities you will be providing as part of your Trips and Experiences. More information on insurance coverage that may be required can be found by contacting the city of Lisbon, Turismo de Portugal, or your local insurance provider.

Depending on the activity you will be providing, you may need to additionally register, obtain licenses, or follow specific rules that apply to that activity. Our section on activity specific licensing requirements and rules covers some of the typical activities, but is not intended to be comprehensive.
